We frequently represent a diverse clientele of individuals, debtors, trustees, unsecured creditors' committees, and creditors in the U.S. Bankruptcy Court in the Western District of North Carolina. We routinely represent clients in litigation involving relief from stay, preferences, lien avoidance, secured transactions, fraudulent transfers and setoffs in the bankruptcy court.
We also represent clients in collections, workouts, deficiency and guaranty defense, landlord-tenant matters, state court receiverships, and other commercial litigation disputes and other matters in state court.
Bankruptcy court experience
Burt Shuford and Martin Hunter have represented literally thousands of individuals and businesses as debtors in the U.S. Bankruptcy Court since they began practicing together in 1992. They have represented consumers, professionals, and small business owners in Chapter 7, Chapter 11, and Chapter 13 cases. In addition, Mr. Shuford has served on the trustee panel of the Bankruptcy Court since 1990. Both Mr. Shuford and Mr. Hunter have served as attorneys for the trustee in bankruptcy cases, and Mr. Hunter has served as counsel for the committee of unsecured creditors in bankruptcy cases. The attorneys at the firm represent creditors in selected cases as well.
State court experience
The attorneys at the firm represent individuals and businesses in civil cases in the Superior and District Courts of Mecklenburg County. These cases include debt collection and commercial landlord-tenant issues. The firm regularly represents one of the major malls in Charlotte in landlord-tenant matters.
Receivership experience
